Final Pay Philippines: Ano ang Dapat Matanggap Pag Nag-Resign?

Nag-resign ka na sa trabaho.

Ano ang Final Pay?
Ang Final Pay ay kabuuang halaga ng sahod at iba pang monetary benefits na dapat pang bayaran ng employer pagkatapos matapos ang employment relationship.
Tinatawag din ito minsan na:
Back Pay
o
Last Pay
Pero sa DOLE guidelines, ginagamit ang term na:
Final Pay
Hindi ito isang special bonus dahil nag-resign ka.
Ito ay settlement ng lahat ng compensation at benefits na legally or contractually due sa iyo hanggang sa iyong last day of employment.
According to the Department of Labor and Employment (DOLE), final pay may include:
Unpaid salary
Pro-rated 13th month pay
Cash conversion of unused leave credits, when applicable
Tax refund, if applicable
Separation pay, if applicable
Retirement pay, if applicable
at iba pang compensation or benefits na maaaring nakasaad sa company policy, employment contract o collective agreement.
Kailan Dapat Ibigay ang Final Pay?
Ito ang isa sa pinakamahalagang rules na dapat malaman ng employee.
Under DOLE Labor Advisory No. 06, Series of 2020, final pay should generally be released:
Within 30 days from the date of separation or resignation.
The DOLE again reminded employers of this requirement in January 2026.
May exception kung ang company ay may mas favorable na policy, individual agreement o collective agreement.
Halimbawa, kung company policy says final pay will be released within 15 days, then the more favorable policy may apply.
Ano ang Kasama sa Final Pay Pag Nag-Resign?
Hindi pare-pareho ang final pay ng bawat employee.
Depende ito sa salary, last payroll received, benefits, leave credits, company policy at iba pang circumstances.
Pero karaniwang dapat i-check ang mga sumusunod.
1. Unpaid Salary
Ito ang pinaka-basic component.
Kung may mga araw kang pinasok pagkatapos ng iyong last payroll cut-off, kailangan pa ring bayaran ang mga iyon.

Last payroll covered:
August 1–15
Pero nagtrabaho ka hanggang:
August 25
Then the salary earned from August 16 hanggang iyong last working day ay maaaring maging bahagi ng final pay.
Kasama rin dapat ang ibang earned compensation na hindi pa nababayaran, subject to applicable payroll rules.
2. Pro-Rated 13th Month Pay
Ito ang madalas nakakalimutan ng employees.
Kahit nag-resign ka bago December, maaari ka pa ring entitled sa proportionate 13th month pay.
For covered rank-and-file employees, DOLE states that employees who resigned or were separated before the regular payment of the 13th month pay remain entitled to a proportionate amount based on the basic salary earned during the calendar year.
The basic formula is:
Total Basic Salary Earned During the Year ÷ 12
= Pro-Rated 13th Month Pay
Example
Suppose you earned a basic salary of:
₱30,000 per month
and worked from January through August.
Assuming ₱240,000 ang total basic salary earned during that period:
₱240,000 ÷ 12 = ₱20,000
Your estimated pro-rated 13th month pay would be:
₱20,000
subject to the actual basic salary earned and payroll records.
Hindi kailangang maghintay hanggang December para maging entitled ang resigned employee sa proportionate benefit.
Ano ang Hindi Normally Kasama sa 13th Month Computation?
Importanteng distinction ito.
The statutory 13th month pay is generally based on basic salary earned.
Normally excluded from the basic salary computation are items such as:
Overtime pay
Night shift differential
Holiday pay
Premium pay
Cash equivalent of unused leave
at certain allowances and benefits that are not considered part of basic salary.
However, they may be included when an employment agreement, collective agreement or established company policy or practice treats them as part of basic salary.
3. Unused Leave Credits

The actual entitlement can depend on:
Law
Company policy
Employment contract
o Collective Bargaining Agreement (CBA).
One important statutory benefit is Service Incentive Leave (SIL) for employees covered by the Labor Code rules.
Generally, a qualified employee who has rendered at least one year of service is entitled to five days of Service Incentive Leave, subject to statutory exceptions.
Unused SIL may be convertible to cash.

4. Tax Refund, If Applicable

5. Other Unpaid Benefits
Depende sa company policy o employment agreement, maaaring may iba ka pang receivables.
Examples include:
Earned commissions
Incentives
Bonuses already earned under applicable rules
Reimbursements
at iba pang compensation na due sa employee.
Hindi automatic na lahat ng bonus ay kasama.
Kung discretionary bonus ito at hindi pa earned according to company rules, maaaring hindi ito payable.

May Separation Pay Ba Kapag Nag-Resign?

Usually, NO.
Kung voluntary resignation ang dahilan ng pag-alis mo, generally hindi ka automatically entitled sa statutory separation pay.
Ang Final Pay at Separation Pay ay magkaibang bagay.

Separation Pay

Let’s make a simple example.
Suppose:
Monthly Basic Salary: ₱30,000
Last Day: August 31
Unpaid Salary: ₱15,000
Total Basic Salary Earned for 13th Month Computation: ₱240,000
Convertible Unused Leave: ₱5,000
Assume no other deductions or adjustments.

Pro-Rated 13th Month Pay
₱240,000 ÷ 12
= ₱20,000
Convertible Leave

Estimated Gross Final Pay

But this is not necessarily the net amount the employee will receive.

Yes, depending on the circumstances and applicable law or agreements.
Possible adjustments may involve:
Outstanding company loans
Salary advances
Unreturned company property
Other valid employee accountabilities
at applicable tax adjustments.
Employers may also implement legitimate clearance procedures.
DOLE itself reminded workers in 2026 that employees separating from employment should complete company clearance requirements and settle accountabilities promptly to avoid unnecessary delays in processing their final pay.
However, clearance procedures should not simply become an excuse for indefinitely withholding money that is legally due.
Kailangan Bang Mag-Render ng 30 Days Pag Nag-Resign?
Generally, employees who resign without just cause are expected to provide the required advance written notice under Philippine labor rules.
But don’t confuse this with the separate rule regarding final pay.
The 30-day resignation notice and the 30-day final pay release guideline are different concepts.
One concerns proper resignation procedure.
The other concerns the employer’s settlement of amounts due after separation.

According to DOLE Labor Advisory No. 06, Series of 2020, the employer should issue a COE:

Employees may also seek assistance through DOLE’s Single Entry Approach (SEnA) dispute-resolution mechanism.
In fact, DOLE regional offices continue to report final-pay disputes being resolved through SEnA.
